By accessing or using our website, you agree to be bound by these Terms. If you disagree with any part of these terms, please do not use our website or services.

Definitions

“Client,” “You,” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions.
“The Company,” “Ourselves,” “We,” “Our,” and “Us,” refers to Kreative Palace.
“Party,” “Parties,” or “Us,” refers to both the Client and ourselves, or either the Client or ourselves.

Services

Kreative Palace offers logo design, web design, graphic design services, and printing products. All services and products are subject to availability and we reserve the right to discontinue any service or product at any time.

Intellectual Property Rights

Our Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Kreative Palace and is protected by international copyright laws.

Client’s Intellectual Property
Upon full payment, the client will own the final deliverables of custom design work. However, we retain the right to display the work in our portfolio unless otherwise agreed upon in writing.

User Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on our website.

Ordering and Payment

Ordering
By placing an order, you are offering to purchase a product or service. All orders are subject to acceptance and availability.

Payment
We accept all major cards. Payment is due upon ordering unless otherwise agreed upon in writing.

Refunds and Cancellations

Our refund and cancellation policy is as follows: Kreative Palace will accept a refund of the design fee if the client is dissatisfied with the final design. The refund will be accepted only if the client can provide a valid reason for dissatisfaction and explains why they do not like the final product within 7 days of starting the project. Services that have already moved from the initial stage to revisions of the next phase or final stage can’t be refunded. No refund will be entertained other than for the mentioned reasons.

Delivery of Services

We will make every effort to complete the services within the timeframe specified. However, delays may occur due to circumstances beyond our control. We are not liable for any loss or damage arising from such delays.

Client Responsibilities

You agree to provide all necessary materials, information, and approvals in a timely manner to allow us to complete the work as agreed.

Limitation of Liability

To the fullest extent permitted by applicable law, Kreative Palace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Indemnification

You agree to indemnify and hold Kreative Palace harmless from any claims, losses, liability, damages, or expenses arising from your use of our website or services, or your violation of these Terms.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever.

Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. We will always post the most current version on our website. By continuing to use the site after changes become effective, you agree to be bound by the revised terms.

Violation of Terms of Use

Kreative Palace may seek legal and equitable remedies against any User who violates these Terms of Use, including but not limited to termination of the Services. Kreative Palace will not be considered to have failed to enforce any provision of these Terms of Use merely because it has failed to act with respect to a breach of such provision.

Down Payments and Adjustments

Adjustments may be required toward the end of the project or when milestones are completed. Upon completion of the task, you should expect some minor adjustments. We will need to adjust your invoice if your payment account shows a smaller balance than the actual amount due.

Unresponsive Client Policy

If the customer has been unresponsive over communications for more than 30 days, we will assume that the client is no longer working on their respective project, and Kreative Palace has the right to charge the remaining balance from their defaulted payment method.

Discount Policy

Discounts are not available to the general public or other entities. Discounts are available only to clients who contract with us directly and pay full price in advance for their design work. Any discount given will be relinquished if you ask for extra modifications to the initial concepts or if you do not respond to our notifications in a timely manner.

Files Ownership

Once we have completed the work for you and delivered it to you, the rest of the unfinalized work does not belong to you and, therefore, cannot be used.

Project Dormancy

Kreative Palace will not be responsible for delivering the project/service if the client is not responding or communicating for more than 6 months after the last conversation date. In this case, the project/service will be on hold, and it requires additional fees (depending on the project/service) to resume work.

Subscription Policy

Subscription-based services are chargeable. Service fees will be charged automatically from the default payment method provided by the client. On a renewal date, these services will be charged automatically, i.e., monthly/yearly, as selected by the client. We will inform the client of every renewal through email by sending them a receipt. No cancellation of the subscription is allowed during the active period. To cancel the subscription, a client has to notify the account manager to cancel their subscription before 15 days. Upon cancellation, the due amount and fees for over days (if applicable) will be charged from the client’s default payment method.
